GENERAL INFORMATION<br><\/b>These General Terms and Conditions regulate the mutual relations between the tourism business, mycroway, Zagreba\u010dka cesta 132a 10000 Zagreb, Croatia, OIB:<br>22061210662, as an organizer of tourist services (e.g. reservation services, tours, excursions, transfers and similar services) (hereinafter referred to as: the business\/organizer) and the traveler, i.e. the person contracting the trip or excursion (hereinafter referred to as: the Traveler).<br>By accepting these General Terms and Conditions, the Traveler confirms that he\/she has read, understood<br>and will comply with the General Terms and Conditions of the business\/organizer. The General Terms and Conditions are an integral part of the tourist service program as well as the Agreement on the same, unless the contracting parties agree otherwise.<br><b>2. MAIN FEATURES OF THE SERVICES<br><\/b>The content, program, prices of tours and excursions, as well as the minimum number of people required to<br>perform the tourist program, are published and available on the website of the craft\/organizer www.mycroway.com and include the contents specified in the description.<br>The Traveler<br>may request certain special and additional services (transfers, additional meals, optional excursions,<br>tickets, insurance, etc.) that are not included in the published program and content, and the craft\/organizer, if it has that option, may arrange them and<br>include them in the program, tour and\/or contract.<br>The Traveler will be informed about the price of special and additional services before concluding the contract<br>and paying for it.<br><b>3. RESERVATION APPLICATION<br><\/b>The Traveler can apply for a trip or excursion via email, the reservation system on the website of the craft\/organizer or by phone. When making a reservation in any form, the Traveler voluntarily writes down the requested information displayed on the reservation system, or the information requested via email or phone call. The Traveler guarantees that he has provided the craft\/organizer with correct and valid information necessary for the smooth implementation of tourist services and accepts all legal obligations arising from the contract and positive legal regulations, and the craft\/organizer undertakes to protect the same information. The reservation becomes valid when the advance payment or the full amount for the requested service is paid. The full amount for the requested excursion or trip must be paid by the agreed date, otherwise the reservation is canceled.<br><b>4. PAYMENT<br><\/b>The advance payment or the full amount is paid depending on the type of tourist service (unless otherwise stated in the description of the service): when confirming the reservation. After visible payment of the full amount, the business\/organizer issues an invoice and a voucher, which is also a confirmation of the reservation, which the Traveler is obliged to present to the business\/organizer immediately before using the tourist service.<br>Payments can be made:<br>\u2022 online (card payment) via the integrated online payment system<br>\u2022 transactional (Internet banking or general payment slip at the bank)5. SERVICE PRICES<br>The prices of tourist services are published in the description of the content on the website of the craft\/organizer mycroway.com and are valid from the date of publication. If it is a tourist service in which the craft\/organizer is an authorized sales agent, the prices are<br>based on the basis of a cooperation agreement between the craft\/organizer and the service provider and\/or<br>organizer and do not have to correspond to the prices on the spot. Any<br>differences in prices cannot be the subject of objections.<br>If there have been changes in the applicable tax regulations, changes in the exchange rate of the agreed<br>currency, an increase in transportation costs, including fuel costs, or an increase in fees for certain services that affect the price, the craft\/organizer reserves the right to<br>change the price no later than 10 days before the start of the tourist service. The price increase is<br>calculated in the same percentage as the change in the aforementioned calculation<br>elements.<br>If the price increase is more than 10 percent of the agreed price, the Traveler has the right to terminate the reservation or contract without any obligation to pay damages. The Traveler is obliged to notify the business\/organizer in writing of the termination of the contract within 2 days of receiving the notification, otherwise it is considered that he\/she agrees to the price change. If the price changes have caused a price decrease, the Agency will refund the Traveler the difference up to the previously agreed amount.<\/p>\n<p><b>6. CATEGORIZATION OF SERVICES<br><\/b>The offered means of transport, accommodation facilities, restaurants and other services are described<br>according to the official categorization of the local tourist organization or other competent<br>body at the time of creating the offer and issuing the program. The standards of food, means of transport, accommodation facilities and other services in individual places and<br>countries are different and are not comparable.<br>The company\/organizer does not assume responsibility for any oral or written<br>information that is not in accordance with the description of the services in the program and the General Terms and Conditions, and which information the Traveler receives verbally from the employee of the sales point, by telephone, in writing from an unauthorized person or in any other way.<br><b>7. MINIMUM NUMBER OF PASSENGERS AND CANCELLATION OF BOOKING BY THE AGENCY<br><\/b>The minimum number of registered passengers is specified in the descriptions of the excursion or trip. In the event of an insufficient number of passengers registered in the description and the travel contract,<br>the business\/organizer has the right to cancel the excursion or trip. The registered Passenger will be notified 12 days before the start of the excursion or trip, and the Passenger has the right to a refund of the price paid up to that time, without the right to compensation. The business\/organizer will refund all payments related to the tourist service without undue delay, and no later than 14 days from the termination of the contract.<br>The business\/organizer will immediately notify the Passenger of any change to the tourist service program. The business\/organizer may cancel the trip no later than 12 hours before departure for reasons that do not constitute extraordinary circumstances that cannot be prevented, avoided or eliminated, in which case the Traveler is entitled to a refund of 100% of the paid price. The business\/organizer may cancel the trip or trip at any time if extraordinary circumstances occur before the start or during the trip or trip that cannot be prevented, avoided or eliminated (war, riots, strikes, terrorist acts, natural disasters, outbreaks of infectious disease pandemics, etc.), in which case the Traveler is entitled to a refund of 100% of the paid price of the tourist service, without the obligation to pay damages. In the event of cancellation of the departure, the Agency may offer the Traveler a second day of departure or an alternative program. The Traveler must state without delay whether he accepts or rejects the replacement program. If the passenger refuses the changes or ignores the offer<br>trade\/organizer, then the contract is terminated and the Traveler has the right to a refund until then<br>paid prices without the right to compensation for damages and possible insurance costs and the like<br>expenses.<\/p><p><b>8. CANCELLATION OF RESERVATION BY THE TRAVELER<br><\/b>If the Traveller wishes to cancel certain tourist services, he must do so in writing to tea.manduric.hr@gmail.com The Traveller may cancel or terminate the tourist services contract at any time before the start of using these services. In that case, the business\/organiser shall be the basis for calculating cancellation costs (unless otherwise specified in the Contract) in the amount that depends on the date of cancellation of the reservation, as follows:<br>\u2022 For tourist services: up to 3 days (or 72 hours) before the start of using the tourist services, the Traveller shall be refunded 50% of the amount,<br>\u2022 For tourist services: up to 1 day (or 24 hours) before the start of using the tourist services, the Traveller shall not be entitled to a refund (the business\/organiser shall retain the entire amount).<\/p>\n<p>According to the above, the business\/organizer will make all refunds to the Traveler, reduced by an appropriate termination fee, without undue delay, and no later than 14 days from the termination of the tourist services contract.<br>Travelers who do not arrive (&#8220;no show&#8221;) at the departure point at the time specified in the reservation confirmation (invoice), voucher or program are not entitled to a refund of the funds paid.<br>The aforementioned cancellation costs apply to changes in the departure date and to all other significant changes made by the Traveler, unless expressly stated otherwise in the program or contract.<br>In the event of unavoidable extraordinary circumstances that occurred at the destination or in its immediate vicinity and that significantly affect the fulfillment of the tourist services or package arrangement and the transportation of passengers to the destination, the Traveler has the right to terminate<br>the contract for tourist services in a package arrangement before the start of the package arrangement without paying any termination fee. In that case, the Traveler is entitled to a full refund of all payments made for the package arrangement, but is not entitled to additional compensation.<br>Act on the Provision of Services in Tourism Art. 37, paragraphs 6 and 7.<br>If the Traveler terminates the contract after the start of the use of tourist services, and the reason is not extraordinary circumstances, the trade\/organizer is entitled to the full amount of the agreed price. In the case of acceptance of the changed departure date, the Traveler has no claims against the trade\/organizer or against the service provider or organizer on any legal basis, except for the right to a partial refund if the alternative program has a lower price.<\/p><p><br><b>9. OBLIGATIONS OF THE TRADE\/ORGANIZER&nbsp;<\/b><\/p><p>The trade\/organizer is obliged to provide the Traveler with services that have the content and characteristics specified in the promotional material (website, flyer, social networks, etc.) and the Tourist Services Contract, in accordance with business practices in this industry, and the Traveler undertakes to pay the trade\/organizer the specified amount for the program or service within the deadline specified in point 4. Payment. Information about the Traveler (name and surname, as well as the names of his\/her companions) that the trade\/organizer receives for the purpose of performing services or tourist service programs may be communicated to third parties directly related to the implementation of the program or at the request of the competent authority. The trade\/organizer is liable for all damage caused to the Traveler by non-fulfillment, partial fulfillment or improper fulfillment of obligations related to the performance of the tourist service program by the trade\/organizer. trade\/organizer is obliged to provide assistance if the traveler finds himself in difficulties<br>extraordinary circumstances that could not be avoided and it is not possible to ensure return<br>of passengers, trade\/organizer is shall bear the costs of necessary accommodation for a maximum of three nights per traveller, if possible in an equivalent accommodation category agreed in the contract. If the Traveller has caused the difficulty intentionally or through negligence, the organiser may charge a reasonable fee for assistance, which may not exceed the actual costs of the trade\/organiser. Also, the trade\/organiser is obliged, without undue delay, to provide the Traveller in difficulty with appropriate information on health services, local authorities and on finding alternative programmes.<\/p>\n<p><b>10. PRIVACY PROTECTION<br><\/b>Your privacy is important to us, therefore we strive to provide clear information about the<br>collection, use, processing of your personal data and with whom we share your personal data when using the services. The business\/organizer undertakes to keep, as a business secret, everything it has learned about the Traveler (his personal data such as: first and last name, his address and place of residence, place and time of use of tourist services, paid price, names of companions, as well as additional notes that the Traveler himself<br>points out) and will not, except with the consent of the Traveler and in cases prescribed by law, make it available to third parties not related to the execution of the program.<br>Our privacy policy is in accordance with the General Data Protection Regulation (GDPR) and we inform you and thus offer you a choice about<br>data that we collect, use and share in the manner described in the Privacy Policy<br>(GDPR) and in these Terms of Business. The traveler provides his personal data voluntarily and, when confirming the reservation, agrees that his personal data will be used for the purpose of booking and implementing the tourist service program. All user data is strictly kept and is only accessible to employees who need this data to perform their job. The business\/organizer explicitly states what data is necessary to make reservations and programs. We are committed to protecting the data of the traveler by collecting only the basic data that is necessary to fulfill our obligations. We inform travelers about the use of the collected data, and we regularly give customers the opportunity to choose how their data will be used, including the opportunity to decide whether or not to remove their name from the list used for newsletters. All employees of the business\/organizer and business partners are responsible for respecting the principles of privacy protection.<br><b>11. OBLIGATIONS OF THE TRAVELER<br><\/b>The traveller is obliged to inform the trade\/organiser of all facts regarding his\/her health, habits, etc., which could jeopardize the provision of tourist services (if, for health or other reasons, he\/she requires a certain type of food, suffers from a chronic illness, allergies, etc.). The programmes contain special notes that need to be known<br>before confirming the reservation. We recommend paying for a health insurance policy in case of using tourist services abroad. The traveller is obliged to submit all information in a timely manner at the request of the trade\/organiser<br>necessary for organizing and performing tourist services in a package arrangement. The traveler is obliged to ensure that his documents and belongings meet the conditions set by the business\/organizer, which relate to the safekeeping of his own personal documents and luggage. The traveler bears the costs of loss or theft of documents during the use of tourist services. The traveler is obliged to comply with the tourist service program and house rules in the catering and accommodation facilities and in the means of transport, and to cooperate with the service providers in good faith. In the event of failure to comply with these obligations, the business\/organizer shall waive any liability for the damage caused, and the traveler shall pay for it at the scene. The traveler is obliged to comply with the rules on personal safety that any average person would use while using the tourist services. The business\/organizer is not liable for the traveler&#8217;s actions that concern his personal liability.<\/p><p><b>12. REPLACEMENT OF PASSENGERS<br><\/b>If the passenger is prevented from starting the use of the tourist services, he may designate a third person to use the services in the tourist services program instead of him if he has notified the business\/organizer in writing. The business\/organizer will accept the third person appointed as a replacement passenger if the third person meets all the stipulated conditions for use and will conclude a Tourist Services Contract. The replaced and new passenger are jointly and severally liable for paying the price and costs incurred by the replacement.<br>A passenger who is prevented from starting the use of the tourist services must notify the business\/organizer at least 3 days before the start of the tourist services. In extraordinary circumstances, a passenger who is prevented from starting the use of these services may notify the business\/organizer of the replacement passenger immediately before the use of the tourist services.<\/p>\n<p><b>13. MINOR TRAVELER<br><\/b>A minor traveller is any person under the age of 18. A minor traveller may<br>participate in tourist services accompanied by a parent or guardian or other responsible person. By signing the contract, the Traveller \u2013 the parent of a minor child\/guardian \u2013 also<br>confirms that the other parent\/guardian is familiar with and expressly agrees to these General Terms and Conditions and the contract, for which he\/she is financially and criminally liable. Alcohol and tastings that include alcohol are not served to minor travellers.<br><b>14. TRADE\/ORGANISER AS INTERMEDIARY<br><\/b>These General Terms and Conditions apply to all programmes where the trade\/organiser is the main organiser\/provider of services, except in cases where the trade\/organiser acts as an authorised intermediary, i.e. is not the main organiser of the programme. The trade\/organiser will inform the Traveller in a contract or booking confirmation, which will specifically state whether it acts as the responsible organiser or intermediary. In the case of mediation in the listed services, the general terms and conditions of the responsible organizer apply and the craft\/organizer is not responsible for the implementation of services by other organizers. When the craft\/organizer acts as an intermediary, it consciously chooses a third party, namely the organizer or performer of the services provided for in the program, and is responsible for his choice.<br><b>15. ROLE OF THE INSURER \/ INSURANCE (if applicable)<br><\/b>The business\/organizer does not currently organize package tours within the meaning of the Act on the Provision of Tourism Services, nor does it provide services for which it is mandatory to obtain liability insurance or liability insurance for package tours. Therefore, it is not necessary to conclude a liability insurance or liability insurance policy for the organizer.<br>If in the future the business expands to package tours or other services for which mandatory insurance is prescribed by law, the business\/organizer will fulfill all legal obligations and obtain an appropriate insurance policy before concluding such contracts with Travelers. At the same time, it will inform Travelers about new conditions and any changes to the General Terms and Conditions.<br><b>16. TRAVEL INSURANCE<br><\/b>Notice on travel insurance (not a mandatory offer)!<br>Since Obrt provides one-day tours, excursions or transfers (without organizing multi-day arrangements), we are not obliged to offer a travel insurance package. However, we recommend that the traveler, if necessary, obtain a travel or health insurance policy, including the possibility of cancellation insurance, which can be concluded directly with the chosen insurer.<\/p><p><b>17. COMPLAINT RESOLUTION<br><\/b>If the Traveler, while using the tourist services, raises a complaint due to the non-fulfillment or improper fulfillment of any of the contracted services, he\/she is obliged to<br>follow the instructions of the organizer\/service provider on the procedure and cooperate with the companion<br>or the person of the craft\/organizer who provides the service, in order to eliminate the cause of the complaint<br>at the place of service provision. If this is not possible, the Traveler is obliged to<br>draw up a written confirmation with the companion or the person of the craft\/organizer that the cause of the complaint could not be eliminated and upon return, submit a complaint to the craft\/organizer<br>within 8 days. The craft\/organizer will only resolve those complaints for which the Traveler<br>provides proof that he\/she has sent a written complaint to the service provider on site and that the cause could not be eliminated on site. The craft\/organizer reserves the right to reject group complaints, complaints that do not arrive within the deadline, and those for which it is determined that the cause could have been eliminated at the place of provision of the service, and the Traveler did not cooperate with the escort or the person of the craft\/organizer who provided the service. In accordance with Article 6 of the Act on the Provision of Services in Tourism and Article 10, paragraph 2. of the Act on Consumer Protection, the Traveler may submit any dissatisfaction with the service provided by the craft\/organizer or, in special cases, the service provider to<\/p>\n<p>in writing to the following addresses:<br><b>\u2022 E-mail: tea.manduric.hr@gmail.com<br>\u2022 Head office of the business\/organizer: Zagreba\u010dka cesta 132a, 10000 Zagreb<br><\/b>The business\/organizer will respond to the Traveler&#8217;s written complaint in writing no later than 14 days from the date of receipt of the complaint. The Traveler is obliged to indicate in his\/her complaint the contact address for the delivery of the response. The business\/organizer may postpone the deadline for resolving the complaint for another 14 days in order to collect information and verify the allegations of the complaint with the service provider or organizer. The Traveler waives the mediation of any other institution or court until the business\/organizer has made a decision, and in total no more than 28 days from the date of filing a written complaint. During this time, the Traveler waives the right to provide information to the public and media. Likewise, during the aforementioned 28-day period, the Traveler waives the right to file a lawsuit. The proportional price reduction per complaint may reach the amount of the unused portion of the services, and compensation for damage caused by non-fulfillment, partial fulfillment or improper fulfillment of the obligations is limited to the amount of the program price. This excludes the Traveler&#8217;s right to compensation for actual damage. In the event of a dispute, the jurisdiction of the law and the court according to the seat of the business\/organizer or service provider shall apply.<br><b>18. FINAL REMARKS<br><\/b>These General Terms and Conditions are an integral part of the Contract and the tourist service program<br>which the craft\/organizer concludes and offers to the Traveler. Possible deviations from these General Terms and Conditions must be stated in the Contract or the description of the tourist service program. These General Terms and Conditions are valid from the date of publication and are the basis for the business methods of the craft\/organizer. The information on these pages and in these General Terms and Conditions is considered correct at the time of entry. All data will be regularly reviewed, and any errors will be immediately removed. The craft\/organizer reserves the right to change the data on these pages without special notice. The official website<br>www.mycroway.com of the craft\/organizer may contain links to the pages of other companies or organizations. RESERVATION APPLICATIONThe Traveler can apply for a trip or excursion via email, the reservation system on the website of the craft\/organizer or by phone. When making a reservation in any form, the Traveler voluntarily writes down the requested information displayed on the reservation system, or the information requested via email or phone call. The Traveler guarantees that he has provided the craft\/organizer with correct and valid information necessary for the smooth implementation of tourist services and accepts all legal obligations arising from the contract and positive legal regulations, and the craft\/organizer undertakes to protect the same information. The reservation becomes valid when the advance payment or the full amount for the requested service is paid. The full amount for the requested excursion or trip must be paid by the agreed date, otherwise the reservation is canceled.4. PAYMENTThe advance payment or the full amount is paid depending on the type of tourist service (unless otherwise stated in the description of the service): when confirming the reservation.
